Terms & Conditions

TERMS

100% payment with conformation of order or as specified on quotation. 

ORDERS

Placing an order with The Nut Machine Company Pty Ltd or Elecmec Engineering & Power cc means your agree and accept our terms & conditions.

AVAILABILITY

Normal delivery time +/- 6 – 8 working weeks, ex manufacture, subject to receipt of material, prior sales and receipt of full deposit.
OR otherwise specified on quotation.

CONDITIONS OF SALE:

  1. Specially manufactured goods cannot be accepted back for credit at any stage.
  2. The order cannot be cancelled, once in process.
  3. Our quotation excludes any commissioning and or installations, except otherwise specified.
  4. The Nut Machine Company Pty Ltd or Elecmec Engineering & Power cc cannot be held liable for any mismatches or ineffective working of components, unless commissioning and installation is done by us.
  5. Prices quoted are F.O.R Polokwane and delivery, crating and shipping and COC will be for the customer account or as otherwise specified.
  6. Manufacturing is based upon what we understand from our customer.
  7. We would like no liability to be extended to us for any delay, impossibility of delivery, where such delay is due to unavailability off material, breakdowns off machinery or any other cause of similar nature to circumstances beyond our control.
  8. Should any changes have to be made, the costs will be for the customer account.
  9. The customer is responsible for the safety of materials and machinery after it has been delivered unto the customer premises. The customer will also  ensure that all material delivered to premises will be protected form the elements including rain, fire and theft and any other natural causes.
  10. Working on customers premises we will need workers and availability of supervisor with authority  from customer  to assist TNMC team.
  11. Any third-party theft or damage to materials and machinery will be the customers account.
  12. All goods remain the property of TNMC until paid in full.

VALIDITY

5 DAYS from date of quotation or as otherwise indicated.

WARRANTY

After delivery or installation and full payment
    1. Equipment is guaranteed against faulty components, workmanship and design for a period of 6 months after installation.
    2. Our guarantee does not cover any consequential loss, damage or injury resulting from failure of our equipment whatsoever.
    3. Any mis-use of equipment will forfeit warranty.
    4. No warranty will be in place if the product/equipment/machine is NOT used for the purpose it was intended for.
    5. Any changes without consent of manufacture will forfeit warranty.
    6. No equipment is guaranteed if foreign particles are processed with the nuts i.e. stones, sticks, bolts, nuts etc. (it remains the customers responsibility to make sure nuts are clean of debris)

DAMAGE LIABILITY
The Nut Machine Company Pty Ltd or Elecmec Engineering & Power cc cannot be held liable for any consequential loss whether suffered or incurred by the customer or otherwise and irrespective of whether such loss or damage arises directly or indirectly from the product/equipment/machine provided by The Nut Machine Company Pty Ltd or Elecmec Engineering & Power cc to the customer.
If, contrary to The Nut Machine Company Pty Ltd or Elecmec Engineering & Power cc any liability is deemed to arise, than such liability is limited to and shall not in any aggregate to exceed to the payment price.

COMPLETION DATES

  1. The customer must adhere to as specified above or quotation for seamless completion of project.
  2. Only upon receiving the deposit will TNMC allocate the necessary resources for the project and if deposits are delayed it will affect the delivery dates as quoted.
  3. It is vital importance that the customer confirms and/or adhere the delivery date giving, as work needs to be allocated into our production schedule.

QUALITY ASSURANCE

The price quoted is based upon most suppliers Standard Level of Quality Assurance (ISO 9001). The cost adherence to any other or additional requirements shall be for the account of the Customer.

FORCE MAJEURE

No liability should extend to us or our sub-contractors for any delay, impossibility of delivery of default in terms of contract, where such delay is due to fires, tempest, acts of God, malicious acts of third party, lockouts, embargoes, breakdown of machinery, insurrection of riots, or any other cause of similar nature to circumstances beyond our control.
